You can file the appeal free of charge on the body's electronic office, with its own appeal form or general application form; you do not need DocMuse for it. This Spanish document, in Spanish, is for challenging an act of a Spanish ministry, regional government or town hall: the recurso de alzada to the higher body, if the act does not end the administrative route, or the recurso de reposición to the same body, if it does. The notification says which applies, to whom and the time limit: one month for an express act. It follows art. 115 of Spanish Law 39/2015; you write the grounds. Not for taxes or traffic fines. File it through a registry.

Common questions
- How do you know whether a Spanish act calls for alzada or reposición?
- The act's notification says so: whether it ends the administrative route, which appeals lie, before which body and within what time (art. 40.2 of Spanish Law 39/2015). If it does not end the route, the alzada goes to the higher body and may also be filed with the body that issued the act (arts. 121 and 122). If it does, the reposición goes to the same body, or you may go straight to the administrative courts (arts. 123 and 124). Naming the appeal wrongly does not stop it being processed (art. 115.2).
- What are the time limits for the Spanish alzada and reposición appeals?
- One month from the day after notification if the act is express; if not, they may be filed at any time once the silence takes effect (arts. 122.1 and 124.1 of Spanish Law 39/2015). The administration has three months to decide an alzada and one month a reposición; if it does not, the appeal is deemed refused, with exceptions (arts. 122.2 and 124.2). Against the decision that ends the administrative route, a court appeal lies within two months (art. 46.1 of Spanish Law 29/1998).
- Where is a Spanish administrative appeal filed, and who writes the grounds?
- On the electronic office, where many bodies have their own free appeal form, through a registry, or at a post office as administrative mail with the envelope open (art. 16.4 of Spanish Law 39/2015). A company or a registered professional acting as such must file electronically (art. 14.2). You write the grounds: this document puts the appeal in order, it does not choose the arguments. A regional or local body in a region with a co-official language must also accept it in that language.
