On what grounds does a Polish court annul a final fixed-penalty ticket?
Only on those in art. 101 of the Code of Procedure for Petty Offences: the act was not an offence, the person was under 17, a statutory exclusion applied (arts. 15–17 of the Petty Offences Code), the prohibitions of art. 96 § 2 were breached, or the fine exceeded the legal maximum — then only the excess is annulled. The application is filed within 7 days of the ticket becoming final, and that deadline cannot be restored.
What if a ticket that was accepted turns out to be unjustified?
Accepting a ticket means agreeing to the penalty, and an art. 101 application is not an appeal — a dispute about the facts, such as who was driving, is not a ground for annulment. Someone who disagrees with the charge should refuse the ticket; the case then goes to court as a motion to punish, where they can defend themselves. Once the ticket is accepted, only the narrow statutory grounds and the 7-day deadline remain.
What happens after an application to annul a ticket is filed?
The district court hears it at a sitting that the penalised person, the authority whose officer imposed the fine, and any victim may attend. If the court annuls the ticket, the fine paid is refunded. It helps to attach a copy of the ticket and evidence for the ground relied on — a document proving age, for instance, or the provision setting the maximum fine.
