A record of handing a car over to a buyer, hirer or other user in Poland, to go with the sale or rental agreement: the date and time of handover, the parties, the make, registration and VIN, the odometer and fuel level, the number of keys, the documents and equipment handed over, and visible damage. The handover time settles who answers for fines, charges and damage, and the description of condition heads off disputes about defects.

Common questions
- Why make a handover record when there is already a sale agreement?
- The agreement says what the parties agreed; the record shows what was actually handed over and when. The exact time shows from when the buyer is responsible for the car, and noting the odometer, fuel, keys, documents and damage heads off disputes about whether a defect existed before handover. The seller is not liable under warranty for defects the buyer knew of when the contract was made (art. 557 § 1 of the Civil Code).
- From when is the buyer responsible for fines and damage caused with the car?
- The driver answers for traffic offences, and from handover the buyer is the one driving. While the former owner is still on the register, speed-camera notices go to them — they then name who received the car and when (art. 78(4) of the Road Traffic Act), and the record with the handover time is the proof. Damage to others is covered by the OC policy, which passes to the buyer with the car.
- How should damage be described in the handover record to avoid disputes?
- Specifically: which parts are damaged, what the damage is and how large — for example “scratch of about 10 cm on the rear left door”, not “signs of use”. It is worth attaching dated photos taken at handover and noting any missing equipment. Vague wording such as “good condition” helps little when it later has to be established whether a defect arose before handover.
