Common questions

Why does a handover record for a car sold in Austria note the hour?
Until deregistration the seller remains the registered keeper (§ 43 Abs 4 KFG). If the car is caught speeding or parked wrongly in that time, the seller must name, within two weeks of a driver enquiry, the person it was left to (§ 103 Abs 2 KFG). The date and hour of handover, signed by both, prove that the buyer had the car from then on. So have the car deregistered as soon as possible.
Why does the Austrian handover record note the car's condition and roadworthiness?
For warranty, what counts is the condition at handover (§§ 922 ff ABGB). If the seller assured something — roadworthiness or freedom from accident damage, for instance — the record shows how the car was at that moment, and visible damage both noted is then no longer in dispute. Note warning lights and the state of the tyres too, and take photos.
Which papers must the buyer receive at handover in Austria?
The Typenschein or, for vehicles with EU type approval from 1 July 2007, the data extract from the approval database; the Zulassungsschein unless it was handed in at deregistration; the latest report under § 57a KFG (the Pickerl); all keys and the service book. To register the car in the buyer's name, the registration office needs, among other things, the approval document and, where the inspection is due, a current report.

    The letter telling your motor liability insurer in Austria that you have sold your car, as § 71 of the Austrian Insurance Contract Act (VersVG) requires: with the policy number, plate, chassis number, date and hour of handover, the buyer's name and address and the day of deregistration.
