The seller's letter to the insurer that a car with OC motor insurance has been sold: the policy number, the vehicle, the date of sale and the buyer's details that art. 32 of the Compulsory Insurance Act requires. Since 10 September 2025 the deadline is 14 days, and until the insurer is told the seller is jointly liable for the premium with the buyer. It does not replace the notice to the district office.

Common questions

How long does a seller have to tell the insurer about selling a car in Poland?
14 days from the transfer of ownership (art. 32(1) of the Compulsory Insurance Act) — the deadline has applied since 10 September 2025; before that it was 30 days. The notice must give the buyer's details: name, address or registered office, and PESEL or REGON number. Until the insurer is told, the seller is jointly liable with the buyer for the premium due from the date of the sale.
Does the seller's OC motor policy pass to the buyer?
Yes — the OC policy passes to the buyer with the car (art. 31 of the Compulsory Insurance Act). The buyer can keep it until the end of the period or cancel it in writing; since 10 September 2025 the cancellation can name the day the policy ends. Cover must stay continuous, though: for any day without OC the Insurance Guarantee Fund charges a heavy penalty.
Does telling the insurer replace reporting the sale to the registration office?
No. They are two separate duties: the district office (starosta) is told within 30 days (art. 78(2)(1) of the Road Traffic Act), in person or online, and the insurer within 14 days. Voluntary comprehensive cover usually ends with the sale under the policy terms, and the seller can claim back the premium for the unused period (art. 813 § 1 of the Civil Code).
