A letter telling your motor insurer in Germany that you have sold the car, as § 97 of the German Insurance Contract Act (VVG) requires without delay: the vehicle, plate, policy number, date and hour of handover, and the buyer's name and address. The policy passes to the buyer with the car (§ 95 VVG); without the notice the insurer may be free from liability for later losses. - Must the sale of a car in Germany be reported to the motor insurer?
- Yes, without delay; either the seller or the buyer may report it (§ 97 VVG). The policy passes to the buyer with the car (§ 95 VVG). If the sale is not reported, the insurer may be free from liability for a loss occurring more than one month after the time by which the notice should have arrived.
- Who pays the motor insurance premium in Germany after the car is sold?
- Seller and buyer are jointly liable for the premium for the current insurance period (§ 95(2) VVG). The buyer may cancel the policy that passed to them within one month of the purchase (§ 96 VVG), and if they take out their own motor liability insurance, the old policy ends. Who bears the premium between the two of you is a matter for the sale contract.
- Is an e-mail enough to report a car sale to a German insurer?
- Yes. § 97 VVG prescribes no form for the notice: you can post this letter signed, or send it as a PDF by e-mail or through the insurer's customer portal. What matters is that it arrives, so keep proof of sending and ask for confirmation of receipt, as the letter does.
- Does notifying the insurer replace the notice of sale to the German registration office?
- No. The insurer and the registration office must each be notified. The seller's motor vehicle tax ends only when the notice of sale reaches the registration office (§ 5(5) KraftStG, § 15 FZV). Send both notices on the day of handover.
