Common questions
- Does a child travelling from Ticino without the parents need a written consent?
- Swiss law does not require one, and there is no federal form. But the FDFA strongly recommends a declaration signed by the parents when a child travels alone, with only one parent or with other people, giving the parents' details and phone numbers, the date, destination, length and purpose of the trip; the Zurich cantonal police advise the same for flights. Each country sets its own entry rules: some ask for their own form or certified signatures. Check with the destination's embassy or consulate before leaving.
- With joint parental authority, is the travelling parent's signature alone enough?
- The parent caring for the child may decide alone on everyday or urgent matters (Art. 301 para. 1bis CC), and third parties in good faith may presume that each parent acts with the other's consent (Art. 304 para. 2 CC). Whether a trip abroad is an everyday matter depends on the destination and length. Border authorities and some countries still ask for the written consent of the parent who stays behind, so it is best that both sign. The declaration is never enough to move the child abroad: that needs the other parent's consent or a decision of the court or the child protection authority (Art. 301a para. 2 CC).
- Who certifies the signatures on a travel consent if the destination country asks?
- The commune of residence or a notary, as the FDFA says; it is needed only if the destination country or the carrier asks, and the document has room for it at the end. Some countries also ask for a translation or their own form, which takes the place of this declaration. Give the declaration to the child together with their passport or identity card and copies of the signing parents' ID.
