Common questions
- How long is there in Italy to answer a disciplinary charge?
- At least five days from receiving the charge (art. 7 of the Italian Workers' Statute); the collective agreement may allow longer. Before that deadline the employer may not impose anything more serious than a verbal warning. The explanation can be given in writing or orally, also with a union representative; a written letter proves the defence arrived in time.
- In Italy, can you ask for a hearing after a disciplinary charge?
- Yes. The worker may ask to be heard in their defence, assisted if they wish by a representative of the union they belong to or appoint (art. 7 of the Italian Workers' Statute). According to the Court of Cassation (no. 23140/2015), even a request made after the five days, but before any measure, must be granted. Unions assist their members free of charge.
- What disciplinary penalties can an employer impose in Italy?
- Those set by the collective agreement and the disciplinary code, which must be posted where everyone can see it (art. 7 of the Italian Workers' Statute): a verbal or written warning, a fine of no more than four hours' basic pay, suspension from work and pay for up to ten days, and in the most serious cases disciplinary dismissal. Any penalty beyond a verbal warning requires a written charge and the five days to be respected.

It is for cases where the collective agreement or the company asks for written notice and offers no portal of its own. Send it by PEC to the company’s certified address, by registered post with proof of receipt, or by hand. It holds health data, so it is sold blank and filled in by hand.
