For couples who live together without being married and want to set out in writing how they share household costs, who owns what and what happens if they separate. The agreement names their autonomous community and refers to its rules on registered couples; in Aragón, the Balearic Islands, Catalonia, Galicia, Navarre and the Basque Country their own regional civil law also applies, according to each partner’s civil residence (vecindad civil). It does not register the couple: registration uses the regional registry’s own form, free to download online. Both sign two copies. In Spanish.

Common questions

Does this agreement register us as a couple in Spain?
No. Registration is requested from the couples’ registry of your autonomous community or town hall, on that registry’s own form, which can be downloaded free from its website; some communities charge a fee to register. In the Basque Country and Andalusia only registered couples count as couples under their law; in Catalonia a stable couple also exists after two years of living together or with a child in common. For a survivor’s pension, registration or a public document made two years before the death is needed (article 221 of the Spanish General Social Security Act): this private agreement is not enough.
Is the same cohabitation agreement valid throughout Spain?
The text follows the general rules of the Spanish Civil Code, valid throughout Spain, and the autonomous community you name points to its rules on couples. Aragón, the Balearic Islands, Catalonia, Galicia, Navarre and the Basque Country have their own regional civil law, applied by each partner’s civil residence (vecindad civil), which may impose rules of its own; in Catalonia, pacts for a break-up are made in a notarial deed (article 234-5 of its Civil Code). If in doubt about your case, ask a professional.
Must a Spanish cohabitation agreement be signed before a notary?
A private agreement between the partners binds both from signature (articles 1255 and 1278 of the Spanish Civil Code). Some communities require a notarial deed for certain pacts, such as those for a break-up in Catalonia, or to register them, and a deed also gives a date that counts against third parties. Sign two copies, one for each partner, and keep copies of both IDs with them.
