Common questions
- How precisely should I describe the matter in a Swiss power of attorney?
- Precisely enough for a third party to see what is allowed, because the scope follows from the content of the power of attorney (Art. 33 para. 2 CO): the subject, the person or office concerned, a reference (parcel, file or plate number), the date. Examples: collecting a registered letter, voting at a given owners' meeting, handing in a vehicle's plates. An end date limits it further, and you can revoke it at any time (Art. 34 CO).
- Must a notary certify the signature on this Swiss power of attorney?
- Not by law: a simple power of attorney needs no particular form (Art. 11 para. 1 CO), and your signature is enough. Some recipients still ask for certification, such as the commercial register or a bank; you then sign before your canton's certifying officer. This power of attorney is not meant for land or other acts needing a public deed: for those, go to a notary.
- Can a relative represent me at a Swiss conciliation hearing?
- Only by exception: at the conciliation hearing you must appear in person. A relative may accompany you, and represents you only if you live outside the canton or abroad or are prevented by illness, age or another important reason; the other side is told (Art. 204 CPC). Before a court, by contrast, any party may be represented by a relative who does not act professionally, on a power of attorney (Art. 68 CPC). Name the proceedings with their number.
