A power of attorney for one transaction or one kind of business in Austria: a visit to an authority, collecting a document, registering a car, handing over a flat, a single sale. Under § 1008 of the Austrian Civil Code (ABGB) it must name the business precisely — for a gift or accepting an inheritance, the single transaction. Before authorities it proves the agent’s authority in writing (§ 10 AVG, § 83 BAO). With an expiry date, restrictions and room for certification if it is used in the land register. Common questions

When does Austrian law require a special power for a single transaction?
Under § 1008 ABGB for a gift, outright acceptance or disclaimer of an inheritance, a partnership contract, the power to choose an arbitrator and giving up a right for nothing: the power must name that very transaction. For selling or buying for value, loans, collecting money, lawsuits and settlements a power for the kind of business is enough, such as all sales of my household goods. For other business an ordinary power will do.
Must the power be shown to an Austrian authority?
Yes: anyone representing another before an authority proves it with a written power (§ 10 AVG), and the same applies at the tax office (§ 83 BAO). For relatives known to the authority, household members and employees the authority may do without it where there is no doubt. Banks and other parties usually want to see the signed original in practice — give it to the agent to take along.
What applies in Austria to a special power used in the land register?
The land register needs the principal’s signature certified by a notary or district court, with the date of birth (§ 31 Abs 1 GBG). An Austrian lawyer cannot certify. If the power names the single transaction — the object, say a particular property with its cadastral community (KG) and entry number (EZ), the other party and, for a transaction for value, the price — the three-year limit of § 31 Abs 6 GBG does not apply (OGH 5 Ob 2232/96p); otherwise the power may be no more than three years old when the application arrives. Sign only before the certifier; notaries also certify online with ID Austria.
