Common questions

When is a power of attorney for one matter enough in Switzerland?
Whenever someone is to handle one specific thing for you: collecting a parcel, voting at an owners' or club meeting, deregistering a vehicle, attending the inspection of a flat. Describe the matter precisely enough for a third party to see what is allowed: the scope follows from the content of the power of attorney (Art. 33 para. 2 CO). An end date limits it further, and you can revoke it at any time (Art. 34 CO).
Does the signature on a Swiss power of attorney need to be certified?
Not by law: a simple power of attorney needs no particular form (Art. 11 para. 1 CO), and your signature is enough. Some recipients still ask for certification, such as the commercial register or a bank; you then sign before your canton's certifying officer. This power of attorney is not meant for land or other acts needing a public deed: for those, go to a notary.
Can the person I appoint appear for me before a Swiss court or conciliation authority?
Before a court, yes: any party with capacity may be represented, also by a person you trust as long as they do not act professionally (Art. 68 paras 1 and 2 CPC); they show the power of attorney, and the court may order you to appear in person (paras 3, 4). At the conciliation hearing, however, you must appear in person: the person you appoint may accompany you and represents you only if you live outside the canton or abroad or are prevented by illness, age or another important reason (Art. 204 CPC). Name the proceedings with their number.
