When the other side does not perform, the contract does not fall away by itself. Rescission requires a written declaration, and before it one normally allows a further period for performance — so this document first sets out the non-performance and the period given, and only then declares the rescission. It also states what is being asked back: sums paid, items handed over, documents.

Common questions

Can I simply stop paying when the other side is not performing?
No. The other side's non-performance does not end the contract by itself — it gives you the right to demand performance or to rescind by declaration. Stopping payment without such a declaration puts you in breach.
Why do I have to allow a further period?
Because as a rule rescission is preceded by a demand allowing a suitable period to perform. There are exceptions, where time was of the essence or performance is already useless, but they are exceptions — and a demand saves you from having to prove one.
What can I get back?
Whatever you gave under the contract — sums paid, items handed over, documents. That is why the notice has a separate field for the return and the period for it, rather than leaving the question for later.
Can I claim damages as well?
Rescission and compensation for loss are different things and are pursued together. So the notice states the loss suffered — leaving it out now makes claiming it later harder.
