A leak from above is the commonest dispute between neighbours and is almost always conducted from memory, because nobody wrote anything down. This notice dates the event, describes the damage and invites the neighbour to a joint inspection — and a refusal to attend is itself a fact that matters later. If an insurer is involved, written notice is the first thing they will ask you for.

Common questions

The neighbour refuses to let me in to inspect. What then?

A refusal is a fact too and is worth documenting — which is why the notice invites them to an inspection at a stated date and time. If access is not given, the fact that you invited them in writing and were refused carries weight at every later stage of the dispute.

The leak has stopped — when should I repair it myself?

Once the damage has been described and photographed, and inspected if possible. Repairing before it is documented makes the amount impossible to prove, and is the commonest reason a neighbour or an insurer disputes the figure.

Can I ask for money straight away?

The notice gives an approximate figure, but its first job is to establish the event and the cause. A claim for a specific sum goes better once there is an inspection, photographs and a repair quotation behind it.

What if the cause is in the common parts rather than at the neighbour's?

Then it is addressed to the manager of the owners' association, not to the neighbour. A shared riser, the roof or a gutter is the responsibility of all the owners — so first establish where it is coming from, and only then who the claim goes to.
