Acknowledgement of debt (Spain)

For someone in Spain who owes money to a private person or a company and acknowledges it in writing, or for the lender who wants that paper signed. The debtor, identified by their DNI or NIE, acknowledges the amount in words and figures and where it comes from, and undertakes to pay it in one sum, by bank transfer, by a set date. The acknowledgement interrupts limitation, and the five-year period starts again (articles 1964 and 1973 of the Spanish Civil Code). The debtor signs it and hands the original to the creditor. In Spanish.

Once the agreed sum is paid the debt is extinguished and a receipt in full settlement is given. It records the negotiation under Organic Law 1/2025 and may be made into a notarial deed. Payment or debt reduction proposal to a creditor (Spain)

For someone in Spain who owes money to a bank, a lender, a utility or a debt collector and wants to offer a smaller lump sum (quita) or instalments (espera) to close the debt. The letter states the amount claimed and the amount offered, the schedule, and makes everything subject to written acceptance stating that, once paid, the debt is settled, with a receipt in full and removal from bad-debtor files. Nothing is paid before that acceptance. Send it by burofax or through the creditor's written channel. In Spanish.

Complaint to a bank's customer service department (Spain)

For a customer of a bank in Spain with a problem over fees, charges, cards, transfers or any other product who wants to complain in writing. It is the compulsory first step: the customer service department has fifteen working days for payment services and one month otherwise; if it does not reply or rejects the complaint, the next step is a complaint to the Banco de España, on its own form. The letter sets out the facts, states what is requested and invites negotiation (Organic Law 1/2025). Hand it in at the branch against a stamped copy, use the bank's online channel, or send it by burofax. In Spanish.

Receipt in full settlement of a debt (Spain)

For a creditor in Spain who has been paid a debt (a loan, an acknowledgement, a payment agreement) and for the debtor who needs proof. With the creditor's signature, it states that the amount, in words and figures, was received as full payment or as the last instalment, and that the debt is settled with its interest and costs, with nothing more to claim (articles 1110 and 1156 of the Spanish Civil Code). It can list the documents returned and the undertaking to have bad-debtor file entries removed. The signed receipt is handed to the debtor. In Spanish.

Settlement agreement between private individuals (Spain)

For two private individuals in Spain with a dispute over money or a contract (a debt, damage, a sale, building work) who settle it without a lawsuit, each giving something up (article 1809 of the Spanish Civil Code). It is a form with fields: the matter, what each side gives or does and by when, the payment and the account, and the waiver of further claims on that matter. It records that the agreement was reached in a negotiation under Organic Law 1/2025 and that either side may have it made into a notarial deed. Not for employment or family matters. Demand for payment with an invitation to negotiate (Spain)

For a private person in Spain who is owed money (a loan, a sale, work done) and wants to claim it before going to court. The letter states the amount in words and figures and where it comes from, asks for payment by bank transfer and invites the debtor to negotiate on that same debt, with the thirty days required since 3 April 2025 by Organic Law 1/2025: without that attempt, a claim is not admitted. It also interrupts limitation (article 1973 of the Spanish Civil Code). It is sent by burofax with certified content and proof of delivery. In Spanish.

Request to close a bank account (Spain)

For the holder of an account with a bank in Spain who wants to close it and not be kept waiting. It points out that the holder may close at any time, that the bank must do so within 24 hours, and that it is free if the account is open-ended or over six months old (article 32 of Spain's Royal Decree-Law 19/2018). Hand it in at the branch against a stamped copy, or send it by burofax. In Spanish.

Cancellation of a direct debit mandate (SEPA) (Spain)

For someone with an account in Spain who wants a company or a person to stop taking payments from it. Two letters: to the bank, revoking that creditor's direct debit mandate (SEPA mandate) so that no further debits are paid; and to the creditor, telling them so and saying how payment will be made from now on, or why the charges are disputed. The revocation applies to debits due after the business day on which the bank receives it (article 52 of Spain's Royal Decree-Law 19/2018). Send them by burofax, by hand against a signed copy or by registered post. In Spanish.

Loan agreement between private individuals (Spain)

For lending money to a relative or a friend in Spain, or borrowing it, and putting it in writing. The agreement, in Spanish under Spanish law, names both parties with their DNI or NIE (Spanish identity numbers) and sets the amount in words and figures, payment by bank transfer, whether the loan is interest-free or the agreed rate, repayment in one sum or in monthly instalments, and what follows a late payment (articles 1740 ff. of the Spanish Civil Code). Both parties sign two copies. The borrower declares the loan, free of charge, to the regional tax office with form 600 or its regional equivalent. In Spanish.

Reply to a debt collector: proof of the debt or limitation (Spain)

For someone in Spain receiving letters, calls or messages from a debt collector or a debt buyer about a debt they do not recognise or that is very old. The letter does not acknowledge the debt: it asks for the contract, the calculation of the amount and proof of the assignment or mandate, and lets you plead limitation where more than five years have passed without a claim or an acknowledgement (articles 1964.2 and 1973 of the Spanish Civil Code). It also asks where your data came from (article 15 GDPR). It is sent by burofax with certified content. In Spanish.

Acknowledgement of debt with a payment plan (Spain)

For someone in Spain who owes money and agrees with the creditor to pay it in instalments. The debtor acknowledges the amount in words and figures and where it comes from; both parties set the number of monthly instalments, their amount, the first date and the payment day, and how many missed instalments let the creditor claim the whole balance. The acknowledgement interrupts limitation (article 1973 of the Spanish Civil Code). The debtor signs, and so does the creditor, who accepts the plan; each keeps a copy. In Spanish.
