Common questions
- Is there an official form for having a Swiss enforcement withheld from third parties?
- Yes: the Federal Office of Justice publishes a free model form for the request (bj.admin.ch, model forms for debt enforcement), and the debt collection offices offer it, or a form of their own, on their websites or at the counter — for instance in the cantons of Thurgau, Fribourg and Basel-Stadt. The form is optional: the law asks only for a request. This letter is such a request, with the details from the payment order, written in German for an office that works in German.
- When can I ask for non-disclosure of a Swiss enforcement, and what does it cost?
- After an objection to the whole claim, from three months after the payment order was served and, since 1 January 2026, for as long as third parties may inspect the enforcement, up to five years after the proceedings end (Art. 8a para. 3 let. d and para. 4 DEBA). The flat fee of CHF 40.00 is owed even if the request is rejected (Art. 12b of the fees ordinance); some offices want it in advance. The request is rejected after an objection to only part of the claim, and if you paid all or part of it during the enforcement.
- Does non-disclosure delete the enforcement from the Swiss register?
- No. The enforcement stays in the register but no longer appears in the extract third parties such as landlords receive. The office gives the creditor 20 days; if the creditor does not prove that proceedings to remove the objection were started in time, the enforcement is no longer disclosed. If the creditor does prove it, the entry stays visible unless you show, with the final decision, that the creditor's request was rejected or not entertained; the letter has a field for it.
- What if I have paid the claim or the creditor is willing to settle?
- Then withdrawal of the enforcement is the simpler route: if the creditor withdraws it at the debt collection office, the office no longer discloses it to third parties (Art. 8a para. 3 let. c DEBA). Ask for the withdrawal in writing, for example as a condition of paying or settling.
