For debtors in Switzerland who objected (opposition) to the whole claim, in French: asks the debt collection office (office des poursuites) under Art. 8a para. 3 let. d DEBA to stop disclosing the enforcement to third parties, at the earliest three months after the payment order was served. The office gives the creditor 20 days to prove proceedings to set the objection aside. The flat fee of CHF 40.00 is owed even if the request fails (Art. 12b of the fees ordinance). The Federal Office of Justice's model form is free. Sent by registered post to the office that issued the payment order, in its official language.

Common questions

Is there an official non-disclosure form in French-speaking Switzerland?
Yes: the Federal Office of Justice publishes a free model form (bj.admin.ch, model forms for debt enforcement), which the offices offer, or a form of their own, on their websites or at the counter. In Geneva the Office cantonal des poursuites also offers an online procedure, and the fee is paid in advance with « non-divulgation » in the payment reference. The form is optional: the law asks only for a request. This letter is such a request, with the details from the payment order, in French for an office that works in French.
From when, and for what fee, can a debtor in Switzerland ask for non-disclosure?
After an objection to the whole claim, from three months after the payment order was served and, since 1 January 2026, for as long as third parties may inspect the enforcement, up to five years after the proceedings end (Art. 8a para. 3 let. d and para. 4 DEBA). The flat fee of CHF 40.00 is owed even if the request is rejected (Art. 12b of the fees ordinance); some offices, Geneva's among them, want it in advance. Offices reject the request after a partial objection, or if you paid all or part of the debt during the enforcement.
Is the enforcement erased from the register once non-disclosure is granted?
No. It stays in the register but no longer appears in the extract third parties such as letting agencies receive. The office gives the creditor 20 days; if the creditor does not prove that proceedings to set the objection aside were started in time, the enforcement is no longer disclosed. If the creditor proves it, the entry stays visible unless you show, with a final decision, that the creditor's request was rejected or declared inadmissible; the letter has a field for it.
Is asking the creditor to withdraw the enforcement a better route after paying?
Often, yes: if the creditor withdraws the enforcement at the office, the office no longer discloses it to third parties (Art. 8a para. 3 let. c DEBA). Ask for the withdrawal in writing, for example as a condition of paying or of a settlement.
