The Federal Office of Justice's model form is free. Sent by registered post to the office that issued the payment order, in Ticino in its official language.

Common questions
- Must a debtor in Ticino use the official form to stop disclosure of an enforcement?
- No, the form is optional. The Federal Office of Justice publishes a free model request (Mod. 2 fac, bj.admin.ch, debt-enforcement forms), which the offices also hand out at the counter. The law asks only for a request, and this letter is one, with the details from the payment order. In Ticino it goes to the Ufficio di esecuzione named on the payment order, which has offices in Bellinzona, Locarno, Lugano and Mendrisio.
- How long after the payment order can a Swiss debtor ask for non-disclosure, and at what fee?
- After an objection to the whole claim, from three months after the payment order was served and, since 1 January 2026, for as long as third parties may inspect the enforcement, which is up to five years after the proceedings close (Art. 8a para. 3 let. d and para. 4 DEBA). The flat fee of CHF 40.00 is owed even if the request is rejected (Art. 12b of the fees ordinance); some offices want it in advance. Offices refuse the request after an objection to only part of the claim, or if you paid all or part of the debt during the enforcement.
- Once a Swiss office grants non-disclosure, is the enforcement gone from the register?
- No. It stays in the register but no longer appears in the extract third parties such as a letting agency receive. The office gives the creditor 20 days; if the creditor does not prove that proceedings to set the objection aside were started in time, the enforcement is no longer disclosed. If the proof comes later or the enforcement continues, the office may disclose it again, unless you show that the creditor's request was finally not granted; the letter has a field for that.
- After paying or settling, is there a simpler route than a non-disclosure request in Switzerland?
- Yes, withdrawal: if the creditor withdraws the enforcement at the debt collection office, the office no longer discloses it to third parties (Art. 8a para. 3 let. c DEBA), with no fee for you. Ask for the withdrawal in writing, for example as a condition of paying or of a settlement, and ask for a copy of the withdrawal.
