For creditors and debtors in Switzerland who agree to clear a debt in instalments, in Italian: the debtor acknowledges the amount, and both agree monthly instalments, the account, a grace period and that the balance falls due if an instalment is missed. Important for the debtor: a signed acknowledgement of debt is a title for provisional removal of an objection (rigetto provvisorio, Art. 82 DEBA) — if the debtor later objects to a payment order, the creditor can have the objection set aside without an ordinary lawsuit. Print two copies and sign both by hand.

Common questions
- What does signing an acknowledgement of debt in Italian commit a Swiss debtor to?
- It gives the creditor a strong tool: with a signed acknowledgement, after an objection the creditor can ask the court for provisional removal of it (Art. 82 para. 1 DEBA). The court grants it unless the debtor at once shows defences that undermine the acknowledgement, such as a payment (para. 2). The debtor then has twenty days to sue for a declaration that the debt is not owed (Art. 83 para. 2 DEBA). Sign only for an amount you really owe.
- What if a Swiss debtor pays an instalment of the plan late?
- If an instalment stays unpaid beyond the agreed grace period, the whole balance falls due at once, with default interest of 5 % a year (Art. 104 CO), and the creditor may start enforcement for it. As long as the debtor pays on time, the creditor does not enforce. If an enforcement is already running, the agreement can provide for its withdrawal after the first instalment: the office no longer discloses a withdrawn enforcement to third parties (Art. 8a para. 3 let. c DEBA).
- Is a special form needed for a Swiss acknowledgement of debt, and can businesses use it?
- The law requires no special form, but provisional removal needs the debtor's signature. The acknowledgement interrupts limitation and a new period starts (Art. 135 no. 1 and Art. 137 CO). This plan grants the deferral without interest or fees, which keeps it outside the Consumer Credit Act (Art. 7 para. 1 let. c CCA). Where a business grants credit commercially, such as a deferral to a private person for interest or fees, that Act may apply (Art. 1 and 2 CCA); this document is not made for that case.
