Common questions
- Must the Austrian Economic Chamber's own form be used to report a dormant trade?
- No. The notice under § 93 Abs 1 GewO 1994 needs no set form: the chamber accepts it by e-mail, post or fax if it names the licence holder, the trade and its location, the GISA number if known, the effective date wanted and a phone number or e-mail address for queries. The regional chambers also offer their own form and eServices free of charge; this letter gives the same details in its own words.
- What deadline applies in Austria to notifying that a trade is dormant or resumed?
- Three weeks, for the suspension and the resumption alike (§ 93 Abs 1 GewO 1994). A backdated notice beyond that period is not possible, and missing it risks a fine of up to €1,090 (§ 368 GewO 1994). Send the letter so that it arrives within the period — e-mail is simplest — and keep the sent message and any confirmation of receipt.
- What does a dormant trade in Austria mean for SVS insurance and the chamber levy?
- The trade licence stays in force, but the trade may not be carried on while it is dormant. Compulsory insurance with the social insurance fund for the self-employed (SVS) ends under the GSVG at the end of the month in which the suspension takes effect, and starts again on resumption. Chamber membership continues and so does the basic levy (Grundumlage); if the trade is dormant for a whole calendar year, only half is payable. Insurance intermediaries are covered by § 93 Abs 2 GewO 1994.
