Common questions
- Does the Consumer Credit Act cover a loan between friends in French-speaking Switzerland?
- No, as long as the lender grants credit neither as a business nor through a crowdlending platform (Art. 2 CCA). Art. 312 ff. CO apply; interest is owed only if agreed (Art. 313 para. 1 CO). The maximum rate for consumer credit (Art. 14 CCA) does not apply, but excessive interest is void to the extent it is contrary to public policy (Art. 20 CO; BGE 93 II 189: 26 % cut to 18 %). Anyone who exploits another's distress, dependence or inexperience to be promised interest in obvious disproportion commits the offence of usury (Art. 157 of the Criminal Code).
- What if a loan agreement in French-speaking Switzerland fixes no repayment date?
- Then the borrower must repay within six weeks of the lender's first demand (Art. 318 CO); the agreement offers this as one option. A fixed date or monthly instalments give more certainty. Demand repayment in writing, preferably by registered post. With the signed receipt, the lender can later prove that the money was paid out.
- How does a private loan appear in a tax return in French-speaking Switzerland?
- The lender lists the claim in the schedule of securities and declares interest received as income; the borrower declares the debt and may deduct interest paid within the legal limits. Both should state the same amount and rate. Keep the signed agreement, the receipt and the payment records; the tax authority may ask for them.
