For private persons in Switzerland lending each other money — family, friends or acquaintances — in English: records the amount, the payout, interest (or none), repayment in one sum, in monthly instalments or within six weeks of being asked (Art. 318 CO) and what happens on default, with a separate signed receipt. The Consumer Credit Act does not apply while neither party lends as a business and no crowdlending platform arranges the loan (Art. 2 CCA). Print two copies and have both parties sign. Swiss authorities and courts work in their official language — German, French or Italian — so this English version is for dealings between private parties.

Common questions
- Are Swiss consumer-credit rules relevant when friends lend each other money in English?
- Not as long as the lender grants credit neither as a business nor through a crowdlending platform (Art. 2 CCA); the language of the agreement makes no difference. Art. 312 ff. CO apply, and interest is owed only if agreed (Art. 313 para. 1 CO). The consumer-credit maximum rate (Art. 14 CCA) does not bind private lenders, but excessive interest is void to the extent it is contrary to public policy (Art. 20 CO; BGE 93 II 189: 26 % cut to 18 %). Exploiting another's distress, dependence or inexperience for interest in obvious disproportion is usury (Art. 157 of the Criminal Code).
- If a Swiss loan agreement has no repayment date, how long does the borrower have once asked?
- Six weeks from the lender's first demand (Art. 318 CO); the agreement offers this as one option. A fixed date or monthly instalments give more certainty. Ask for repayment in writing, ideally by registered post (Einschreiben). With the signed receipt, the lender can later prove that the money was paid out, which matters if the loan is ever enforced.
- Do both parties to a private loan in Switzerland have to declare it for tax?
- Yes. The lender lists the claim in the schedule of securities and assets and declares interest received as income; the borrower declares the debt and may deduct interest paid within the legal limits. Both should give the same amount and rate. Keep the signed agreement, the receipt and the payment records, as the tax office may ask for them, in its own official language.
