The step to take when a controller has not answered your request or has refused it without good reason. The order is the same as in consumer disputes: first a request to the organisation, then a complaint to the commission with a copy of the correspondence attached. A complaint with no prior request is usually sent back, because there is no refusal to examine.

Common questions

Can I complain without having written to the organisation?
As a rule no. The commission examines a case where a request has been made and refused or ignored. A complaint with no prior request is usually sent back, because there is no conduct to examine.
What can the complaint achieve?
An inspection, binding directions, and a penalty for the controller. Compensation for loss suffered is pursued separately, through the courts — the commission exercises supervision rather than awarding sums.
What should I attach to the complaint?
A copy of your request, proof that it was made, and the answer if there was one. Without those three the complaint describes a problem but does not show that the organisation had a chance to solve it.
Is there a time limit for filing?
Yes — a complaint is filed within a period from learning of the breach, and for older matters there is a long-stop as well. Do not delay: an expired time limit is a ground in itself for no file to be opened.
