Disputing a contract made through cold calling (France)

This document is in French
The PDF you download is in French — that is the language it has to be filed in, so it is not translated. Everything on this page is here to tell you what it says.
For a consumer in France who was called without having agreed to it and is then, according to the business, bound by an energy, telecom, building-work or subscription contract. Since 11 August 2026, telephone canvassing without prior consent has been banned, and a contract concluded after such a call is void (Article L. 223-1 of the French Consumer Code, rewritten by Law No. 2025-594 of 30 June 2025). The letter relies on this and, as you choose, also states that you signed no confirmation of the offer (Article L. 221-16) or exercises your 14-day right of withdrawal. In French, to send by registered post with proof of receipt; also report the call on SignalConso.

Common questions
- What changed for cold calling in France on 11 August 2026?
- A business may no longer canvass by phone a consumer who has not given prior consent (Article L. 223-1 of the French Consumer Code, rewritten by Law No. 2025-594 of 30 June 2025). Consent must be free, specific, informed, unambiguous and revocable; a pre-ticked box is not enough, and the business must prove it. A contract concluded after a banned call is void. The Bloctel opt-out list has ended. Calls about a current contract are still allowed.
- Is a consumer in France bound by a contract accepted orally on the phone?
- No. After canvassing by phone, the business must send you a confirmation of its offer on paper or another durable medium, and you are bound only once you have signed and accepted it on a durable medium (Article L. 221-16 of the French Consumer Code). If you did sign, you still have the 14-day withdrawal period (Article L. 221-18). The letter offers both situations; choose the one that matches yours.
- Where can unwanted cold calls be reported free of charge in France?
- On SignalConso (signal.conso.gouv.fr), the DGCCRF's free service: the report is passed to the business and used for inspections, which can lead to an administrative fine, but it does not settle your dispute. For that, send this letter; if the business still bills you, go free of charge to the consumer mediator it belongs to. Note the date, time and number of each call.
