The agreement by which an author in Romania — a designer, a programmer, a photographer, a writer — assigns a company the economic rights in a work, with everything Law no. 8/1996 requires on pain of annulment: the rights assigned and, for each, the uses, the term and the extent of the assignment — territory included — and the pay; it also says whether the assignment is exclusive. Moral rights stay with the author, because the law does not let them be assigned.

Common questions
- What must a Romanian copyright assignment contain?
- Under Law no. 8/1996, the economic rights assigned and, for each, the uses, the term and the extent of the assignment, and the author's pay. Leaving these out lets the interested party ask for the contract to be annulled, and the contract can be proved only in writing.
- Can moral rights be assigned too?
- No. The right to be recognised as author, to decide whether and when the work is made public and to insist on its integrity cannot be assigned (arts. 10–11 of Law no. 8/1996). The agreement concerns only the economic rights — reproduction, distribution, adaptation and the other uses.
- Does a company own the rights in work made for it?
- Not automatically. For works an employee creates in the course of their duties, the economic rights belong to the author unless the contract says otherwise, while for software they belong to the employer, again unless agreed otherwise. With a PFA or a freelancer, the rights stay with the author until a written assignment — which is why this agreement exists.
