Common questions

On which dates can a private insurance policy be ended under Swiss law?
The Insurance Contract Act calls it withdrawal (recesso): ordinarily for the end of the third insurance year or any later year, with three months' notice, also for contracts made before 2022 (Art. 35a and 103a LCA/VVG). Earlier termination applies only if agreed, with the same periods for both sides (Art. 35a para. 2). On a premium increase the general conditions usually give a right to terminate for the date it applies. For good cause you may withdraw at any time (Art. 35b). The three-year rule does not apply to life insurance (Art. 35a para. 3).
Is an e-mail a valid way to terminate an insurance policy in Ticino?
Yes: besides writing, the Act accepts any form that allows proof by text (Art. 35a para. 1 LCA/VVG), so an e-mail or the customer portal will do. But you must prove that the notice arrived in time, at least three months before the end date. So registered post, sent with a few days to spare, is safer; keep a copy and the receipt. In Ticino the consumer association ACSI also offers its members a free model letter on private insurance.
Can my health insurer end my supplementary cover, and can I withdraw from a policy I just signed?
In supplementary health insurance only the policyholder has the ordinary right to withdraw (Art. 35a para. 4 LCA/VVG): the insurer can end the contract only in exceptional cases such as fraud, a breach of the duty to disclose or unpaid premiums, not because you change basic insurer. A new contract can be withdrawn from within fourteen days, in writing or text form, without reasons; posting it on the last day is enough (Art. 2a). Cancel supplementary cover only once new cover is confirmed.
