The written notice of parental part-time work (Elternteilzeit) to an Austrian employer under § 15j of the Maternity Protection Act (MSchG) or § 8b of the Fathers' Leave Act (VKG): start, length, hours and their pattern, the child, and since when you have been employed. Common questions

When is there a right to parental part-time work (Elternteilzeit) in Austria?
When the business has more than 20 employees, your employment has lasted three years without a break when the part-time starts, and the child lives in your household (§ 15h MSchG, § 8 VKG). Hours must fall by at least 20 % and may not go below twelve a week. If a condition is missing, Elternteilzeit can only be agreed (§ 15i MSchG); the document then asks for an agreement.
By when must Elternteilzeit be notified in Austria, and how long can it last?
In writing at least three months before it starts. If it is to start straight after the protection period, the mother notifies by the end of that period and the father no later than eight weeks after the birth (§ 15j MSchG, § 8b VKG). It lasts at least two months. For a child born on or after 1 November 2023 it lasts at most until the child's eighth birthday and seven years in all, less the maternity ban and Karenz for the same child. For a child born earlier the old limit applies: the seventh birthday, or a later start at school.
Is an e-mail enough to notify Elternteilzeit in Austria?
No. The MSchG and VKG require a written notice, and in Austria written means signed (§ 886 ABGB): by hand on paper or with a qualified electronic signature, for instance with ID Austria (§ 4(1) SVG). Hand over the signed letter against a dated confirmation on your copy, or send it by registered post early enough to arrive in time. A PDF signed with ID Austria is sent as the file itself.

  • Notice of illness during holiday (Austria)

    An employee in Austria who falls ill on holiday does not lose the days: if the illness lasts more than three calendar days, the days of incapacity are not counted against the holiday entitlement (§ 5 UrlG, the Austrian Holiday Act). The employer must be told without delay after three days, and a doctor's confirmation shown on returning to work. This letter records both, with the holiday dates and the start and expected length of the incapacity, without a diagnosis — and a choice for illness abroad, where an official confirmation or a hospital's confirmation is needed.   • Notice of care leave to the employer (Austria)

    The notice telling an employer in Austria that you are taking care leave (Pflegefreistellung) under § 16 UrlG, the Austrian Holiday Act: to nurse a sick close relative or a sick member of your household, to look after your child when the person who normally cares for it is unavailable, or to stay with a child under ten in hospital. You choose whether this is the first week, the second week for a child under twelve who falls ill again or, once both are used, holiday taken without agreement (§ 16 Abs 3 UrlG).
