For a self-employed person or business in Spain with an overdue unpaid invoice: a courteous Spanish reminder identifying the invoice, its amount and due date, asking for payment or for proof if already paid, and recalling that late-payment interest and recovery costs under Spain's Law 3/2004 run from the due date. Sent by e-mail or, for proof of content, by burofax; if payment does not follow, the next step is the demand with an invitation to negotiate. In Spanish.

Common questions
- How does this reminder differ from the demand for payment sent by burofax?
- The reminder is a courteous notice to get paid without conflict: it neither demands nor formally invites negotiation. The demand with an invitation to negotiate is the step before a court claim, because since 3 April 2025 a claim is not admitted in Spain without that attempt (Organic Law 1/2025). If the reminder does not work, send the demand by burofax.
- Does late-payment interest run even before it has been claimed?
- Yes. Between businesses in Spain, the debtor is in default and owes interest from the invoice's due date without any notice (art. 5 of Law 3/2004), at the European Central Bank rate plus eight points, plus 40 euros per invoice for recovery costs. The reminder mentions it and lets you waive it if payment comes soon, which often helps you get paid.
- How do I send the payment reminder: by e-mail or by burofax?
- A courteous reminder can go by e-mail to whoever handles the client's payments. If you want to be able to prove later what you sent and when, use a burofax with certified content and acknowledgement of receipt. For the attempt to negotiate that Spain's Organic Law 1/2025 requires before a claim, the right text is the demand for payment with an invitation to negotiate, also sent by burofax.
