Payment reminder for an overdue invoice (Italy)

This document is in Italian
The PDF you download is in Italian — that is the language it has to be filed in, so it is not translated. Everything on this page is here to tell you what it says.
For a business or professional wanting to remind a client of an overdue invoice before a formal demand: a polite letter in Italian with the invoice number, date and amount, the due date, a request to pay within a few days with the IBAN, and a reminder that between businesses late-payment interest runs anyway from the day after the due date (Legislative Decree 231/2002). If payment is already on its way, it asks the client to disregard it. Sent by e-mail or PEC; if it fails, a formal demand follows.

Common questions
- Does a payment reminder start interest running on an invoice between Italian businesses?
- It does not need to: between businesses, and between businesses and self-employed workers, late-payment interest runs automatically from the day after the due date (Legislative Decree 231/2002), and a flat €40 for recovery costs is also due. A reminder mentions the debt politely and keeps the client relationship open. If the client does not pay, the next step is a formal demand or notice of default, which also interrupts limitation.
- How is a payment reminder best sent to an Italian company?
- For a first reminder an e-mail is enough, but PEC leaves proof of sending and delivery: every company has a PEC address, which can be found free of charge in the INI-PEC register. A PEC sent to an ordinary e-mail address proves no more than an e-mail. Keeping the receipts helps if the matter later goes to a formal demand or an injunction order.
- After how long does an unpaid invoice become time-barred in Italy?
- The ordinary limitation period is ten years (art. 2946 of the Civil Code), but for many periodic claims or particular categories the law sets shorter periods, for example five years for amounts payable yearly or at shorter intervals (art. 2948). A polite reminder is not always an act that interrupts limitation; a written notice of default is (art. 2943). For older debts, a formal demand is the better step.
