The written agreement on care leave (Pflegekarenz, § 14c of the Austrian Employment Contract Law Adaptation Act, AVRAG) or reduced hours for care (Pflegeteilzeit, § 14d AVRAG) to look after a close relative: the relative and their care allowance level, the kind, start and end — one to three months — the hours during part-time (not below ten) and the return. Common questions
- Who can agree on care leave or reduced hours for care in Austria?
- Employees whose employment has lasted at least three months, to care for a close relative who has been awarded care allowance (Pflegegeld) at level 3 or above — level 1 for a relative who is a minor or has dementia (§ 14c AVRAG). One to three months are agreed; reduced hours may not go below ten a week (§ 14d AVRAG). This is possible once per relative in principle, and once more if the care level rises.
- Is there a right to care leave (Pflegekarenz) in Austria?
- Only a short one. In businesses with more than five employees there is a right to care leave or reduced hours for care for up to two weeks, and, if no agreement on a longer period is reached in that time, for two more weeks. The full period of up to three months needs the employer's written consent, which is why both sign this document.
- Where is the care leave allowance (Pflegekarenzgeld) claimed in Austria?
- From the Sozialministeriumservice, on its own application form — not from the employer and not with this document. Apply within two weeks of the start of the care leave or reduced hours: the allowance is then paid from the start, otherwise only from the day of the application, and not at all once the leave has ended (§ 21d BPGG). The allowance is based on unemployment benefit, and paid pro rata for reduced hours. The agreement with the employer is its basis: it must be in writing, signed by hand or with a qualified electronic signature (§ 886 ABGB, § 4(1) SVG); an exchange of e-mails is not enough.

Under the Austrian Salaried Employees Act (§ 8 Abs 8 AngG) and Continued Remuneration Act (§ 4 Abs 1 EFZG) the absence is reported without delay, and the confirmation of incapacity (Arbeitsunfähigkeitsbestätigung) shown when the employer asks. An employee in Austria who falls ill on holiday does not lose the days: if the illness lasts more than three calendar days, the days of incapacity are not counted against the holiday entitlement (§ 5 UrlG, the Austrian Holiday Act). The employer must be told without delay after three days, and a doctor's confirmation shown on returning to work. This letter records both, with the holiday dates and the start and expected length of the incapacity, without a diagnosis — and a choice for illness abroad, where an official confirmation or a hospital's confirmation is needed. The notice telling an employer in Austria that you are taking care leave (Pflegefreistellung) under § 16 UrlG, the Austrian Holiday Act: to nurse a sick close relative or a sick member of your household, to look after your child when the person who normally cares for it is unavailable, or to stay with a child under ten in hospital. You choose whether this is the first week, the second week for a child under twelve who falls ill again or, once both are used, holiday taken without agreement (§ 16 Abs 3 UrlG).
