Common questions

How much time must pass between the invitation and the preliminary meeting in France?
The meeting cannot take place less than five working days after the registered letter is presented or the letter is handed over (article L. 1232-2 of the Labour Code); the count starts the next day, and Sundays and public holidays off work do not count. For misconduct, the procedure must be started within two months of the employer learning of the facts (article L. 1332-4).
Who may accompany the employee at the preliminary meeting in France?
A person of their choice who works in the company. If the company has no staff representatives, the employee may instead choose an employee adviser from the list drawn up by the prefect, and the invitation must give the addresses of the labour inspectorate and the town hall where the list can be seen (articles L. 1232-4 and R. 1232-1 of the Labour Code). A missing statement is a procedural irregularity, which can cost up to one month's pay in damages (article L. 1235-2).
What happens after the preliminary meeting in France?
If the employer decides to dismiss, it notifies the decision by registered post with proof of receipt, no sooner than two working days after the date set for the meeting (article L. 1232-6 of the Labour Code) and, for a disciplinary dismissal, no later than one month after it (article L. 1332-2). The collective agreement may add further safeguards. A protected employee, a pregnant employee or the victim of a workplace accident is covered by special rules this model does not cover.

  • Dismissal letter for personal reasons, disciplinary or not (France)

Decree no. 2017-1820 of 29 December 2017 publishes free model dismissal letters on Légifrance, whose outline this document follows. It is the letter by which a French employer notifies an employee of dismissal for personal reasons (misconduct, serious or gross misconduct, professional inadequacy) in mainland France or an overseas department other than Mayotte: precise reasons, notice, suspension, end-of-contract documents and the request for details (articles L. 1232-6 and R. 1232-13 of the Labour Code). Sent by registered post with proof of receipt, at least two working days after the meeting and, for misconduct, within one month. In French.

  • Request for details of the reasons for dismissal (France)

A letter for an employee dismissed in mainland France or an overseas department other than Mayotte, asking the employer to make precise the reasons given in the dismissal letter (articles L. 1235-2 and R. 1232-13 or R. 1233-2-2 of the Labour Code). It must go within fifteen days of being notified of the dismissal, by registered post with proof of receipt or by hand against a receipt; the employer then has fifteen days to answer. A standard form: it does not challenge the dismissal and does not replace an application to the employment tribunal. In French.

  • Paternity leave notice (France)

A letter by which the employed father, or the mother's employed spouse, civil partner (PACS) or cohabiting partner, tells the employer the expected date of birth and the dates of paternity and childcare leave (congé de paternité et d'accueil de l'enfant, article L. 1225-35 of the French Labour Code) in mainland France or an overseas department other than Mayotte: four compulsory days after the birth leave, then twenty-one days (twenty-eight for multiple births) in one or two periods within six months. Send it at least one month ahead, by registered post with proof of receipt or against a receipt. In French.

  • Notice of parental leave or the additional birth leave (France)

A letter for an employed parent in mainland France or an overseas department other than Mayotte, telling the employer that they are taking parental leave (congé parental d'éducation), full-time or as part-time work (articles L. 1225-47 and L. 1225-50 of the French Labour Code), or the additional birth leave available since 1 July 2026 (congé supplémentaire de naissance, articles L. 1225-46-2 et seq.; decree no. 2026-419 of 30 May 2026). These leaves are a right once the conditions are met: the letter sets the dates, and the law calls for registered post with proof of receipt or hand delivery against a receipt. In French.

  • Withdrawal of a signed final-settlement receipt (France)

A letter for a former employee in mainland France or an overseas department other than Mayotte who wants to denounce the final-settlement receipt (reçu pour solde de tout compte) signed at the end of the contract. Sent within six months of signing, it stops the receipt from discharging the employer from the amounts listed in it (article L. 1234-20 of the Labour Code), and can name the amounts disputed. The withdrawal goes by registered post (article D. 1234-8 of the Labour Code) and the six months run from signing: use proof of receipt and send it early enough to arrive in time. In French.

  • Resignation letter (France)

The French labour ministry's site code.travail.gouv.fr offers a free model resignation letter. This document is a resignation letter for an employee on an open-ended contract (CDI) in mainland France or an overseas department other than Mayotte: it gives notice of resignation, refers to the notice period set by the collective agreement, the contract or custom, can ask to be released from working it, and asks for the end-of-employment documents. French law prescribes no form; send it by registered post with proof of receipt or hand it over against a signed receipt, to prove the day the notice starts. In French.
