For a consumer in Spain who already asked for a faulty product to be repaired or replaced and did not get it: the company did not do it within a reasonable time, refused, the fault came back or it is serious. The letter requires the seller to reduce the price in proportion or to end the contract and refund the money (arts. 119 to 119 ter of the Spanish Consumer Protection Act, TRLGDCU), and includes the invitation to negotiate that Spanish Organic Law 1/2025 requires before suing. Send it by burofax with certified content. In Spanish.

Common questions

When can I ask in Spain for a price reduction or my money back instead of a repair?
When repair and replacement are impossible or disproportionate, the company has not carried them out or not within a reasonable time, has refused, the fault reappeared after its attempt, the fault is so serious that it justifies immediate action, or the company has made clear it will not bring the goods into conformity (art. 119 of the Spanish TRLGDCU). Ending the contract with a refund is not available if the lack of conformity is minor (art. 119 ter); a price reduction then remains.
How is a price reduction calculated in Spain, and what happens to the product if I end the contract?
The reduction is proportionate to the difference between the value the goods would have without the fault and the value of the goods you received (art. 119 bis of the Spanish TRLGDCU); the letter lets you propose an amount. Termination is exercised by a statement to the company, which is this letter (art. 119 ter): you return the goods and the company refunds the price. Keep the product as it is and keep the invoice, the earlier claim and the repair reports: they prove what happened.
How do I send this claim in Spain, and what can I do if the company does not reply?
By burofax with certified content: it proves what was sent and when, and counts as the attempt to negotiate that Spanish Organic Law 1/2025 requires before going to court; the company has thirty calendar days to reply. If it does not reply or there is no agreement, you can file a free complaint with the consumer office (OMIC) or your region's consumer service, ask for consumer arbitration if the company accepts it, or go to court. The Spanish associations OCU and FACUA publish free model letters for these claims.

  • Legal guarantee claim for repair or replacement (Spain)

For a consumer whose product, bought from a business in Spain, turned out faulty or not as agreed: the letter requires the seller to repair or replace it free of charge under the three-year legal guarantee that runs from delivery (arts. 114 ff. of the Spanish Consumer Protection Act, TRLGDCU), within a reasonable time and without shipping costs. It includes the invitation to negotiate that Spanish Organic Law 1/2025 requires before going to court. Send it by burofax with certified content, which proves what was sent and when. In Spanish.

  • Claim for compensation for a delayed or cancelled flight or denied boarding (Spain)

For a person on a flight that arrived three hours or more late, was cancelled at short notice or on which boarding was denied: the letter claims from the airline the €250, €400 or €600 compensation under Regulation (EC) No 261/2004 for each passenger on the booking, and invites it to negotiate as Spanish Organic Law 1/2025 requires before suing. If the airline does not answer within a month or refuses, a complaint to AESA, Spain's aviation safety agency, is free and its decision binds the airline. Send it by burofax or through the airline's complaint form. In Spanish.
