The demand in which a consumer in Romania, after the product was not repaired or replaced in time or the fault came back, asks for a proportionate price reduction or for the contract to be ended and the money refunded, under Emergency Ordinance no. 140/2021. When can a consumer in Romania get their money back for faulty goods?
When the product was not brought into conformity within the legal time or the seller refuses, when the fault returns after repair, when the lack of conformity is serious enough to justify ending the contract straight away, or when the seller has said it will not fix it (Emergency Ordinance no. 140/2021). For a minor lack of conformity, only a price reduction can be asked for.
How is the price reduction worked out?
In proportion to the difference between the value of the faulty product and what a conforming one would have been worth. The demand states the sum asked for, and if the seller disputes it, the consumer can turn to ANPC, an alternative dispute resolution body or the courts.
Who pays for returning the product once the contract is ended?
The seller. After the contract is ended, the consumer returns the product at the seller's expense, and the seller refunds the price on receiving the product or proof that it was sent (Emergency Ordinance no. 140/2021).
