The notice by which a consumer in Romania withdraws from an online, phone or off-premises purchase within 14 days — 30 if the contract was made during an unsolicited visit to the home or on an excursion organised by the trader — without giving a reason (Emergency Ordinance no. 34/2014). It identifies the product and the order, asks for every payment — standard delivery included — to be refunded within 14 days to the account given, and announces the return of the goods. It follows the content of the model in the ordinance's annex.

How long does a consumer in Romania have to withdraw from an online purchase?

14 days, with no reason needed (art. 9 of Emergency Ordinance no. 34/2014). For goods, the period runs from receipt; for services, from the contract being concluded. For a contract made during an unsolicited visit by the trader to the home or on an excursion it organised, the period is 30 days. If the seller did not tell the consumer about the right of withdrawal, the period is extended by up to 12 months.

When must the trader refund the money after a withdrawal?

Within 14 days of being told of the withdrawal, standard delivery included (art. 13 of Emergency Ordinance no. 34/2014). The trader may hold the refund until it gets the goods back or proof that they were sent, whichever comes first.

Are there purchases a consumer cannot withdraw from?

Yes. The law excludes, among others, goods made to the consumer's specifications, perishable goods, sealed goods unsealed after delivery that cannot be returned for hygiene reasons, digital content downloaded with the consumer's consent, and services fully performed with their consent (art. 16 of Emergency Ordinance no. 34/2014).
