Complaint about a faulty product (Romania)

How long is a Romanian seller liable for faulty goods?

Two years from delivery under Emergency Ordinance no. 140/2021, and a fault that shows within the first year is presumed to have existed at delivery — the seller must prove otherwise. A manufacturer's commercial guarantee comes on top and does not replace the legal one.

How quickly must the product be repaired or replaced?

Within a reasonable time, agreed in writing, of no more than 15 calendar days from the seller being told of the lack of conformity, free of charge and without significant inconvenience to the consumer (art. 11 of Emergency Ordinance no. 140/2021). If the lack of conformity is found within 30 calendar days of delivery, the consumer is entitled to a replacement.

What if the repair does not work?

The consumer can ask for a proportionate price reduction or for the contract to be ended with a refund if the product is not brought into conformity in time, the fault comes back, the lack of conformity is serious or the seller refuses. There is a separate demand for that.
