For a consumer in Moldova who bought goods or a service online, by phone or away from the trader's premises and has changed their mind. The notice withdraws from the contract within the 14-day period under articles 1059 and 1060 of the Civil Code of the Republic of Moldova (no. 1107/2002), with no reason needed, and asks for a refund within 14 days. The standard form in Annex 6 to Law no. 1125/2002 implementing the Civil Code, or the trader's own online form, does the same job free. Send it through Poșta Moldovei by registered letter with acknowledgement of receipt, or by email where accepted, and keep proof of sending.

Common questions

How long do I have to withdraw from an online contract in Moldova?
14 days. For goods, the period runs from the day you, or someone you name other than the carrier, take possession of them; for an order delivered in several parts, from the day the last part arrives. For a service, it runs from the day after the contract was made. If the trader never told you about the right of withdrawal, the period runs for 12 months longer. Your notice is in time if you send it before the period ends (arts 1054, 1060 and 1061 of the Civil Code).
Which distance contracts cannot be withdrawn from in Moldova?
Among others: goods made to your choices or clearly personalised; goods that spoil or expire quickly; sealed goods unsealed after delivery that cannot be returned for health or hygiene reasons; sealed audio or video recordings and software unsealed after delivery; newspapers and magazines, other than subscriptions; accommodation, car hire, catering and leisure booked for a set date; and a service fully performed, or digital content supplied, after you agreed to it starting and accepted losing the right of withdrawal (art. 1065 of the Civil Code).
Who pays for sending the goods back after withdrawing from an order in Moldova?
You pay only the direct cost of sending them back, unless the trader agreed to pay it or did not tell you that you would. The trader refunds the standard delivery charge, but not the extra for a faster delivery you chose, and may hold the refund until it has the goods back or proof that you sent them. You answer only for a loss in value caused by handling the goods more than was needed to see what they are and how they work (arts 1063 and 1064 of the Civil Code).
What can I do in Moldova if the trader does not refund me after I withdraw?
Free of charge, you can petition the State Inspectorate for the Supervision of Non-Food Products and Consumer Protection (ISSPNPC): on consumator.gov.md or through edemocratie.gov.md, with an electronic signature. If you paid by card, ask your bank whether it can claim the money back through the card scheme's chargeback procedure. You can also claim the money in court, at the competent district court (judecătorie). The general limitation period is three years (art. 391 of the Civil Code).
