The PDF you download is in Italian — that is the language it has to be filed in, so it is not translated. Everything on this page is here to tell you what it says.

For an employer and employee in Italy who want confidential information protected after the job ends, when the duty of loyalty under art. 2105 of the Italian Civil Code lapses. The agreement defines the confidential information, how long the duty lasts after the job ends, the exceptions (public information, legal duties, whistleblowing reports) and the return of documents. It is not a non-compete clause: it does not restrict future work and sets no penalty. In Italian.

Common questions

Does an employee's duty of confidentiality in Italy continue after the job ends?
The duty of loyalty under art. 2105 of the Italian Civil Code, which forbids an employee to disclose the business's information, applies during the job and ends with it. To protect information afterwards a separate agreement like this one is needed, with a set duration. Trade secrets remain protected in any case by articles 98 and 99 of the Italian Industrial Property Code.
What is the difference in Italy between a confidentiality agreement and a non-compete?
A confidentiality agreement forbids disclosing and using information but leaves the worker free to work anywhere. A non-compete (art. 2125 of the Italian Civil Code) restricts work after the job ends: it is void unless written, paid for and limited in subject, time and place, and may not exceed five years for executives and three for others. This form contains no non-compete.
How long can confidentiality last in Italy after the job ends?
The law sets no period: the parties choose one in proportion to the value of the information. The agreement must, however, only forbid disclosing and using the information: if in practice it stopped the worker from working in the sector, it would fall under art. 2125 of the Italian Civil Code and be void without payment and limits. The exceptions in article 4 (public information, legal duties, whistleblowing reports) always apply.

It is for cases where the collective agreement or the company asks for written notice and offers no portal of its own. Send it by PEC to the company’s certified address, by registered post with proof of receipt, or by hand. It holds health data, so it is sold blank and filled in by hand.

The application goes first to INPS, online and free, or through a patronato; this letter then gives the employer the details of the authorisation, with a copy enclosed, and the monthly schedule of days or hours, which the employer may ask for. The letter does not describe the disability. Send it by registered post, PEC or by hand. In Italian.

  • Resignation letter during pregnancy or with a child under three (Italy)

The letter states the notice or, within the child's first year, that none is due, and the last working day. Sent by hand, registered post or PEC. In Italian.
