Common questions

Is an automatic renewal clause in a Swiss gym contract binding?
Only if it was properly agreed. The Swiss consumer foundation (Stiftung für Konsumentenschutz) regards an automatic renewal found only in the small print as unfair (Art. 8 UWG); it stands if you were clearly told about it when signing and are reminded in good time before the renewal date. This letter expressly objects to any tacit renewal. Check the term and notice period in your contract.
Can I end a gym contract in Switzerland early after an injury or a move?
Yes, for good cause: a subscription is a continuing contract that can be ended early for serious reasons, and the general terms cannot exclude that. The Swiss consumer foundation names lasting illness, an accident, pregnancy or moving far away from the gym; you need not settle for a pause of the membership. Prove the reason, for example with a doctor's certificate, and ask for a pro-rata refund.
Must a Swiss gym accept notice by e-mail, and where are free model letters?
The contract decides the form: if the terms require one, you generally have to use it, though excessive hurdles such as notice by fax only can be abusive. Proving that your notice arrived in time is up to you, so a registered letter and a written confirmation are safest. The consumer organisations publish model letters: the Stiftung für Konsumentenschutz and K-Tipp in German, the FRC in French on frc.ch, and the ACSI in Ticino for its members.
