For consumers, contracts for recurring deliveries follow Art. 20 of the Consumer Protection Act (KSchG); otherwise the contract decides, and a provider may not require a stricter form than a signed letter. Common questions
- With how much notice can a subscription be cancelled in Liechtenstein?
- As a rule, with the notice and on the date the contract sets. A consumer's contract for repeated deliveries of goods, energy included, or repeated work, made for an indefinite time or more than a year, can be ended with two months' notice to the end of the first year and then of each half-year (Art. 20 Abs. 1 KSchG); notice given late takes effect on the next date (Abs. 4). The letter therefore cancels to the next possible date.
- Can a provider in Liechtenstein insist on a particular form of notice?
- Towards consumers, a contract term requiring a stricter form than writing, or special conditions for receipt, is not binding (Art. 8 Abs. 1 Bst. d KSchG). A signed letter meets the written form (§ 886 ABGB). Send it by registered post and keep the postal receipt: it proves sending, and the tracking shows delivery; if the contract allows notice by e-mail or in the customer account, that works too.
- My subscription renewed itself: does that hold in Liechtenstein?
- A term under which certain conduct, such as silence, counts as a consumer's declaration binds only if, when the period for it began, the provider specially pointed out what that conduct would mean and allowed a reasonable time for an express declaration (Art. 8 Abs. 1 Bst. b KSchG). Whether your renewal holds therefore depends on whether you received such a reminder in time. Either way, this letter cancels to the next possible date.
- I signed up online only days ago: should I cancel or withdraw?
- From a distance or off-premises contract you can withdraw within 14 days without giving reasons, for services from the day of the contract (Art. 12 FAGG). Withdrawal needs no form, the model withdrawal form in Annex Part B of the FAGG is free to use, and sending it within the period is enough (Art. 14 FAGG); the business refunds your payments within 14 days (Art. 15 FAGG). This letter is a notice of cancellation, not a withdrawal.
- Who can help in Liechtenstein if the provider does not accept the cancellation?
- For phone and internet, the conciliation body under the communications legislation; for electricity and gas, the one under the electricity and gas market legislation; otherwise the Office of Economic Affairs (Amt für Volkswirtschaft) as the catch-all body (Art. 4 Abs. 1 and 3 AStG). Taking part is free for the parties unless otherwise provided (Art. 12 AStG). Enclose your notice and the postal receipt. After that, a claim at the Landgericht remains.
