Common questions

How long may a gym in Austria bind a member by contract?
There is no fixed statutory maximum. The courts judge the binding case by case under § 6 Abs 1 Z 1 KSchG: a waiver of notice for 24 or 36 months is void; the OGH once upheld first notice after twelve months and every six months after that (5 Ob 205/13b), but later also struck down bindings of 16 and twelve months. Ending the contract for good cause, such as a serious illness, must always be possible.
Does the notice rule of § 15 KSchG in Austria apply to a subscription?
§ 15 KSchG covers contracts for recurring deliveries or works that run for more than a year or indefinitely — typically a magazine subscription. You can then give two months' notice for the end of the first year and afterwards for the end of each half-year. The OGH does not apply § 15 KSchG directly to a gym, because the contract is mainly one of hire (5 Ob 205/13b); there, what counts is whether the binding period is reasonable. Whether the rule reaches a streaming plan is not settled; in the document you choose the route yourself, and it gives notice for the next possible date in the alternative.
Does a subscription in Austria renew automatically without notice?
Only if the contract provides for it and the trader, at the start of the period in which you can object, specifically pointed out what your silence would mean and left you a reasonable time to answer (§ 6 Abs 1 Z 2 KSchG). Without that reminder, the contract ends on the date originally agreed. Then choose the notice for the original end date in the document and send it signed by registered post.
Are there free model letters for cancelling a gym membership or subscription?
Yes. Austria's Chamber of Labour (Arbeiterkammer) and the consumer association VKI publish free model letters for many consumer matters on their websites, and you can just as well use one of those.
