What notice applies to ending a mobile or internet contract in Austria?
A minimum term may last at most 24 months, and every provider must also offer a contract of at most twelve months (§ 135 TKG 2021). During that term you give notice for its end, unless the contract is changed to your disadvantage. After it, you can end the contract at any time on at most one month's notice. Count the notice from the day the letter reaches the provider.
Can a mobile or internet contract in Austria be ended when the provider raises prices?
Yes, if the change is not solely to your benefit. You can then end the contract extraordinarily and free of charge until the change takes effect, with no remaining charges for the minimum term; prepaid charges are refunded pro rata (§ 135 TKG 2021 with the 2023 notification regulation, MitV 2023). A rise under an index clause already agreed in the contract does not, as a rule, give this right. Choose the extraordinary notice in the document and send it so that it reaches the provider before the change takes effect.
How can a customer in Austria prove that a notice reached the phone or internet provider?
A notice takes effect only once it is received, and in a dispute the sender must prove receipt; posting an ordinary letter does not prove it (OGH 2 Ob 108/07g). Send the signed letter by registered post and keep the posting slip, or hand it in at a shop against a confirmation on a copy. If the provider offers notice in its customer portal, save the confirmation.
Are there free model letters for cancelling a mobile or internet contract?
Yes. Austria's Chamber of Labour (Arbeiterkammer) and the consumer association VKI publish free model letters for many consumer matters on their websites, and you can just as well use one of those.
