Common questions
- Does a Swiss gym membership renew automatically?
- Only if that was agreed. The Swiss consumer foundation regards an automatic renewal found only in the small print as unfair (Art. 8 UWG); it is acceptable if you were clearly told about it when you signed and are reminded in good time before the renewal date. The letter expressly objects to any tacit renewal. Check the notice period and term in your contract.
- Can I end a Swiss gym membership early because of illness, pregnancy or a move?
- A subscription is a continuing contract that can be ended early for an important reason, and the terms cannot exclude that. The Swiss consumer foundation names lasting illness, an accident, pregnancy or a move far from the gym as such reasons; you need not accept merely pausing the membership. Prove the reason, for instance with a doctor's certificate, and ask for a pro-rata refund.
- May I cancel a subscription in Switzerland by e-mail?
- It depends on the contract: if the terms require a particular form, you generally have to use it, though very high hurdles such as cancellation by fax only can be abusive. You must prove that the notice arrived in time, so the Swiss consumer foundation advises a registered letter and a written confirmation from the provider.
