Common questions
- Will my gym membership in Ticino roll over if I do not cancel in time?
- Only if renewal was agreed. The Swiss consumer foundation regards an automatic renewal found only in the small print as unfair (Art. 8 LCSl/UWG); it is acceptable if you were clearly told about it when signing and are reminded in good time before the renewal date. The letter expressly objects to any tacit renewal. Check the term and the notice period in your contract.
- Which reasons let me leave a gym or subscription in Switzerland before the term ends?
- Good cause: a subscription is a continuing contract that can be ended early for serious reasons, and the terms cannot exclude that. The Swiss consumer foundation names lasting illness, an accident, pregnancy or a move far from the gym; you need not accept a mere pause of the membership. Prove the reason, for instance with a doctor's certificate, and ask for a pro-rata refund.
- Is there a model letter in Ticino for cancelling a gym, and is an e-mail enough?
- The ACSI, the consumer association of Italian-speaking Switzerland, offers the model letters «Fitness» and «Abbonamenti», free for members (acsi.ch). As to form, the contract decides: if the terms require a particular form, you generally have to use it, though excessive hurdles such as cancellation by fax only can be abusive. You must prove that the notice arrived in time, so a registered letter and a written confirmation from the gym are the safest route.
