Common questions

Is a fitness club membership in Switzerland renewed without my consent?
Only if renewal was agreed. The Swiss consumer foundation SKS regards an automatic renewal found only in the small print as unfair (Art. 8 LCD); it is acceptable if you were clearly told about it when signing and are reminded in good time before the renewal date. The letter expressly objects to any tacit renewal. Check the notice period and the term in your contract.
Can illness, pregnancy or moving away justify ending a gym contract early in Switzerland?
A subscription is a continuing contract that can be ended early for good cause, and the terms cannot exclude that. The Swiss consumer foundation SKS names lasting illness, an accident, pregnancy or a move far from the club as such causes; you need not accept merely pausing the membership. Prove the cause, for example with a medical certificate, and ask for a pro-rata refund.
Is an e-mail enough to cancel a gym or other subscription in Switzerland?
It depends on the contract: if the terms require a particular form, you generally have to use it, though excessive hurdles such as cancellation by fax only may be abusive. Proving that the notice arrived in time is up to you, so consumer organisations advise a registered letter and a written confirmation from the provider.
Is there a free French-language model letter for cancelling a gym membership?
Yes: the Fédération romande des consommateurs (FRC) publishes a model letter for cancelling a gym membership on frc.ch, alongside its advice on subscriptions. This letter also covers other subscriptions, price increases and pro-rata refunds, with fields to fill in.
