Common questions

Can the seller of a used car in Switzerland exclude every warranty?
In principle yes between private people, but not without limits: the clause is void for defects the seller fraudulently concealed (Art. 199 CO), it does not cover what the seller expressly assured, and liability for intent or gross negligence cannot be excluded (Art. 100 para. 1 CO). Under BGE 130 III 686 it also does not cover a defect entirely outside what a buyer had reasonably to expect. Inspect the car at once and report defects immediately (Art. 201 CO).
Who keeps the plates after a Swiss car sale, and how does the buyer register the car?
The plate number stays reserved for the previous holder (Art. 87 para. 1 VZV): the seller removes the plates and returns them unless they go on another of the seller's vehicles within 14 days (Art. 74 para. 5 VZV). The buyer receives the original registration certificate and registers the car with it and a liability insurance certificate at the vehicle office of the buyer's canton (Art. 74 para. 1 let. b VZV). If the certificate shows code 178 ('change of holder prohibited'), the leasing or credit company must consent first. Ask the office whether it requires an inspection beforehand.
From when is the buyer the owner of the car under Swiss law?
Ownership of a vehicle passes with the transfer of possession (Art. 714 para. 1 CC). A retention of title only works if entered in the register at the buyer's domicile (Art. 715 para. 1 CC), so this contract provides that the car, keys and certificate are handed over only against the full price (Art. 184 para. 2 CO). Without agreement, benefit and risk would pass when the contract is made (Art. 185 para. 1 CO); here they pass at handover. Keep the signed receipt.
