For a private seller and buyer of a used car or motorcycle in Malta: a contract that identifies the vehicle by registration and chassis number, records the odometer reading and the defects the seller knows of, states the price and how it is paid, chooses whether the Civil Code's warranty against latent defects applies, and says who completes the Transport Malta transfer and pays its fees. Signed receipts for the money and the vehicle are attached.

Common questions

How is a car's ownership transferred after a private sale in Malta?
Through Transport Malta: on its transfer application, VEH 50, signed by the seller and the buyer before a witness, or online through an authorised insurance agent or broker. The buyer needs insurance in their own name. Transport Malta charges an administration fee, and its site lists the current fees. Do it on the day of the handover, so that fines and charges after the sale reach the right person.
Can a private seller in Malta sell a car without any warranty?
Yes. Under article 1426 of the Civil Code (Cap. 16) a seller may stipulate that they give no warranty for latent defects they did not know of, and the contract lets you choose. A seller who knew of a defect still answers for it, with damages (article 1429). Without that stipulation the buyer of a movable has six months from delivery to sue for a hidden defect, or from when it could be discovered (article 1431).
Who pays a parking or speeding fine after I sell my car in Malta?
Fines go to the registered owner, and in law the seller remains responsible until they have given Transport Malta notice of the sale, which they must do within seven days (regulation 27 of the Registration and Licensing of Motor Vehicles Regulations, S.L. 368.02). So do the transfer on the day of the handover. Between the handover and the transfer, this contract makes the buyer answer to the seller for any contravention, fine or charge arising from the car's use, and the receipt of the vehicle records the date and time it changed hands.

Related documents

  • Motor insurance claim letter (Malta)

For a driver or vehicle owner in Malta claiming for damage after a road accident, either from the insurer of the vehicle that caused it or under their own policy: a letter setting out the accident, the vehicles, the damage and the amount, with the evidence, and asking for a reasoned offer or reply within the three months that Cap. 104 sets for third-party claims. Send it by registered letter with a copy by email, and keep the post office receipt.

  • Petition against a traffic fine (Malta)

For a driver or vehicle owner in Malta who received a warden's or traffic contravention notice they believe is wrong: a written petition to the Petitions Board, giving the notice number, the vehicle, the grounds and the evidence, and asking for the contravention to be cancelled; if the Board refuses, the charge goes before the Commissioner for Justice. The online petition of the Local Enforcement System Agency (LESA) is free; this text can be pasted in or sent by registered letter.

  • Contract of service for an indefinite time (Malta)

For an employer and an employee in Malta agreeing a permanent job: a written contract of service under the Employment and Industrial Relations Act (Cap. 452) setting the start, the probationary period, the job and place of work, hours, wages paid at most four weeks in arrears, statutory bonuses, leave, and notice by length of service as article 36 requires. Both sign two copies and each keeps one.

  • Mutual non-disclosure agreement (Malta)

For two businesses or individuals in Malta who will share confidential information while they talk about working together — a joint project, an investment, a supplier or partner relationship. Each promises to keep the other's information confidential, use it only for the stated purpose and return or destroy it on request, for a number of years both choose; trade secrets are also protected by the Trade Secrets Act (Cap. 589). Both sign it, and each keeps an original.

  • Loan agreement between individuals (Malta)

For two people in Malta — family, friends or acquaintances — where one lends the other a sum of money. The agreement records the amount, how and when it is repaid, and any interest, which the Civil Code limits to 8% a year (article 1852). Both sign it as a private writing and each keeps an original; the borrower signs a separate receipt when the money is handed over. It is not for loans made by a business, which follow consumer credit rules.

  • Settlement agreement (Malta)

For two parties in Malta — individuals or businesses — who settle a money dispute out of court: unpaid work, damage, a deposit, a debt in dispute. The agreement records the dispute, the sum agreed and when it is paid, and that both give up the rest of their claims about it once it is paid. The Civil Code requires a compromise to be in writing (article 1233). It is for disputes not yet before a court or tribunal. Both sign it and each keeps an original.
