A private agreement for the sale of a used car or motorcycle between individuals in Cyprus: the vehicle, the price and payment, handover, condition and known defects. The agreement does not change the registered owner — that is done with form TOM 9Γ at the Road Transport Department or a citizen service centre (KEP), with insurance in the buyer's name. Does a private sale agreement transfer the vehicle to the buyer in Cyprus?
No. The registered owner changes only with the transfer at the Road Transport Department: form TOM 9Γ, completed by seller and buyer, is filed at a Department office or a citizen service centre (KEP), together with the original certificate of insurance in the buyer's name, running for at least three months. If both attend, a Department officer certifies their signatures on sight of their identity cards; a party who does not attend has the signature certified by a certifying officer. Until then the seller remains the registered owner. The agreement binds both to complete the transfer by a set date and says who pays its fees.
What does the Road Transport Department in Cyprus ask about manufacturer recalls at a transfer?
Since February 2025 the Department checks, before every transfer, whether a manufacturer recall is pending for the vehicle, such as the recalls for faulty airbags. The seller produces a certificate that no recall is pending, issued by the brand's importer or dealer. Where a recall is pending, the transfer goes ahead with a statement of knowledge signed by both buyer and seller. The agreement records which applies, so the buyer knows what is being bought.
Does a vehicle sale agreement in Cyprus need stamp duty?
No. Stamp duty was abolished from 1 January 2026 by Law 239(I)/2025, and no private agreement is stamped any more. The charges paid are the Road Transport Department's transfer fees, and the agreement says who pays them. The signatures need no certification; the agreement is signed in two identical copies, one for each party.
Is there a guarantee when buying a used vehicle from a private seller in Cyprus?
The legal guarantee of conformity applies when a trader sells to a consumer, not in a sale between private individuals. In a private sale what counts is what is agreed: the seller answers for what the agreement states, such as charges on the vehicle, its mileage and its known defects. That is why it is worth having the vehicle checked by a garage before signing, and recording precisely the defects the seller mentioned.
