Common questions
- How far does a warranty exclusion go when a used car is sold privately in Ticino?
- Between private people the exclusion is valid in principle, with three limits the contract writes out: it is void for defects the seller fraudulently concealed (Art. 199 CO); it does not cover what the seller assured, such as the accident history and mileage stated in the contract (BGE 109 II 24); and liability for intent or gross negligence cannot be excluded (Art. 100 para. 1 CO). Nor does it reach a defect entirely outside what a buyer had reasonably to expect (BGE 130 III 686). Examine the car as soon as you receive it and tell the seller of a defect at once (Art. 201 CO).
- Who keeps the plates, and where is a car bought privately in Ticino registered?
- The plates stay with the seller, for whom the number is reserved (Art. 87 para. 1 VZV): the seller removes them at handover and returns them unless they go on another vehicle within 14 days (Art. 74 para. 5 VZV). The buyer registers the car with the original registration certificate and a liability insurance certificate at the road traffic office of the buyer's canton (Art. 74 para. 1 let. b VZV); in Ticino that is the Sezione della circolazione of the Department of Institutions. If the certificate shows code 178, the leasing or credit company must consent first. Ask the office whether it wants an inspection.
- Why does the contract hand the car over only once the full price is paid?
- Because ownership of a vehicle passes with possession (Art. 714 para. 1 CC), and a retention of title only works once entered in the register at the buyer's domicile (Art. 715 para. 1 CC). So the contract applies simultaneous performance (Art. 184 para. 2 CO): car, keys and certificate against the whole price, in cash or once the transfer is credited. Without agreement, benefit and risk would already pass when the contract is made (Art. 185 para. 1 CO); here they pass at handover. The signed receipt proves payment: keep it.
