Common questions

Do I have to complain on the spot about a package holiday booked in Ticino?
Yes: any failure in performance you notice on the spot must be reported as soon as possible, in writing or another suitable form (Art. 12 para. 1 of the Package Travel Act). The Act names the service provider, such as the hotel, and the organiser or retailer (the Italian text says “or”, the German and French “and”), so tell both. The organiser must then promptly seek a solution (para. 2). Note when and to whom you reported the problem, and keep photos and receipts for your complaint after the trip.
What can I claim from a Swiss tour organiser when services were missing?
If a substantial part of the agreed services is not provided after departure, the organiser must arrange alternatives or the journey home and pay the difference between the price of the planned and of the services provided (Art. 13). It is liable for proper performance even when the hotel or airline failed (Art. 14 para. 1), except for the traveller's own failings, unforeseeable or unavoidable failings of an uninvolved third party and force majeure (Art. 15). For damage other than personal injury it may cap compensation at twice the price, not for intent or gross negligence (Art. 16).
When must a package-holiday complaint reach the organiser, and who mediates in Switzerland?
The Act sets no period after the trip, but the contract must state the period within which you must complain of non-performance or poor performance (Art. 6 para. 1 let. f). Check your travel conditions and send the complaint before then, by registered post. If you cannot agree, the Ombudsman of the Swiss Travel Industry mediates free of charge for consumers, without power to decide (online form at ombudsman-touristik.ch). After that, the route is the conciliation authority.
