This document is in Italian
The PDF you download is in Italian — that is the language it has to be filed in, so it is not translated. Everything on this page is here to tell you what it says.
For a pregnant employee, or a mother or father in the child's first three years (adoptive or foster children included), resigning in Italy. These resignations do not go through the online procedure: they are given in writing to the employer and take effect only once confirmed, free of charge, by the territorial labour inspectorate (Ispettorato territoriale del lavoro). The letter states the notice or, within the child's first year, that none is due, and the last working day. Sent by hand, registered post or PEC. In Italian.

Common questions
- How do you resign in Italy during pregnancy or with a child under three?
- With a letter to the employer, handed over with a signed copy, sent by registered post or by PEC, followed by a request for confirmation (convalida) to the territorial labour inspectorate, in person or remotely using the inspectorate's form, enclosing an identity document and the letter. Confirmation is free and without it the resignation has no effect (art. 55(4) of Italian Legislative Decree 151/2001). The forms are free on the website of the national labour inspectorate.
- In Italy, does someone resigning within the child's first year have to give notice?
- No. A resignation given while dismissal is banned, that is until the child turns one, requires no notice and gives the right to the payments due on dismissal (art. 55(1) and (5) of Italian Legislative Decree 151/2001; Ministry of Labour ruling no. 28/2014). After the first year and up to three years the confirmation is still required, but the notice under the collective agreement is due.
- In Italy, does the confirmation of a resignation also apply to fathers?
- Yes. A father's resignation in the child's first three years, or after an adoptive or foster child arrives, must be confirmed by the territorial labour inspectorate just like the mother's (art. 55(4) of Italian Legislative Decree 151/2001). Exemption from notice in the first year applies to the father in the cases set out in the same art. 55, in particular when he has taken paternity leave.

It is for cases where the collective agreement or the company asks for written notice and offers no portal of its own. Send it by PEC to the company’s certified address, by registered post with proof of receipt, or by hand. It holds health data, so it is sold blank and filled in by hand.

The form covers three cases: a contract of up to twelve months with no stated ground, replacing other workers, and technical, organisational or production needs identified by the parties, allowed for contracts signed by 31 December 2026; grounds set by a collective agreement are not included. It states term, duties, the statutory trial-period formula, pay and the right of precedence. The term counts only if written; the copy is due within five working days. In Italian.

The application goes first to INPS, online and free, or through a patronato; this letter then gives the employer the details of the authorisation, with a copy enclosed, and the monthly schedule of days or hours, which the employer may ask for. The letter does not describe the disability. Send it by registered post, PEC or by hand. In Italian.
